Terms and Conditions

NOTE: This Agreement contains a binding arbitration clause, class-action waiver, and non-disparagement covenant that affect your legal rights. Read carefully before signing or purchasing.

01. Acceptance of Terms

By scheduling a consultation, purchasing a product, placing a deposit, enrolling in a subscription, or otherwise engaging with Leva Medical PC (the "Practice," "Leva," "we," "our"), you ("Patient," "you," "your") acknowledge that you have read, understood, and agree to every provision in these Terms & Conditions (the "Terms"). If you do not agree, do not proceed.

02. Definitions

Products - Retail skincare, nutraceuticals, garments, or other tangible goods.

Services - Consultations, non-surgical treatments, memberships, and subscriptions.

Procedures - Surgical or minimally-invasive operations by our licensed providers.

03. Eligibility & Pre-Screening

Services and Procedures are provided only to established Patients who have completed an intake visit. New clients must call or text 718-699-9737 to schedule their intake before purchasing. We reserve the right to deny service in our sole discretion.

04. Payment Responsibility

You agree to (a) maintain a valid payment method on file and (b) pay each invoice on or before its due date. Late or missed payments:

  1. Automatically cancel all scheduled Services and Procedures;
  2. May result in forfeiture of credits, discounts, and deposits proportional to the services already rendered or reserved on your behalf; and
  3. Accrue a 1.5% monthly late fee (18% APR) plus any collection, chargeback, attorney, or credit-reporting costs we incur.

Statement Descriptor: Charges from Leva Medical will appear on your bank or credit card statement as "LEVA MEDICAL" or "LEVA MEDICAL PC." If you do not recognize a charge, contact us at Levamedical@gmail.com or (718) 261-1154 before contacting your bank.

05. "All Sales Final" Policy

Except as expressly provided in § 10 or as required by law, all payments - deposits, Procedures, Services, Subscriptions, Products, and shipping - are irrevocable and non-refundable. Initiating a credit-card chargeback, ACH reversal, or check stop-payment without first following the dispute resolution process in Section 11 constitutes a material breach of these Terms.

06. Internal Payment Plans

If denied third-party financing, we may - in our sole discretion - offer an internal installment plan:

  1. Equal payments every 30 days.
  2. Two missed installments close the account, forfeit all amounts paid, and make the entire balance immediately due.
  3. You authorize us to charge any card or payment method on file until paid in full.

07. Subscriptions & Memberships

By enrolling, you:

  1. Commit to a fixed initial term (6 or 12 months depending on the program) beginning with the first successful charge (the "Initial Term").
  2. Authorize Leva Medical P.C. to charge your card or payment method on file for recurring automatic payments at the amount and frequency shown at checkout.
  3. Understand that your enrollment fee (if applicable) and your first recurring membership payment are two separate charges that may be processed on consecutive days.
  4. May cancel by written notice at least 30 days before the next billing cycle, sent to Levamedical@gmail.com, by calling (718) 261-1154, or by using the same method you used to enroll (including online if you enrolled online). Leva Medical will not impose unreasonable conditions on or delay your cancellation request.
  5. Understand that cancellation during the Initial Term may result in an Early Termination Fee representing Leva Medical's estimated unrecovered costs, calculated as the lesser of (i) 50% of remaining payments in the Initial Term or (ii) the total remaining balance. This fee reflects the discount applied to your membership rate in exchange for a term commitment and is a reasonable pre-estimate of damages that are otherwise difficult to calculate.
  6. After the Initial Term, the Subscription converts to month-to-month and may be canceled with at least 30 days' written notice with no Early Termination Fee.
  7. Will receive a renewal reminder between 15 and 45 days before the cancellation deadline for any renewal term of six months or longer, sent via the communication method you selected.
  8. Understand that skipping shipments or treatments does not pause or extend your commitment.
  9. Will be notified of any pricing changes at least 30 days in advance. If the price increases, you may cancel for a prorated refund of the current billing period or affirmatively consent to the new price before being charged.
  10. Acknowledge that benefits are non-transferable and non-refundable.
  11. Agree to maintain a valid payment method on file. If your payment method expires or is declined, you must provide updated payment information within 10 business days of notification. Your payment obligations continue regardless of payment method status.

08. Surgical Deposits & Scheduling

  1. Deposit - A non-refundable $1,000 deposit reserves your surgery date; remaining balance due 14 days pre-op.
  2. Reschedule - One complimentary date change with at least 14 days' notice; later or additional changes incur a $500 fee.
  3. No-Show / Same-Day Cancel - The full surgical fee is forfeited.

09. Non-Disparagement

You agree not to post or publish any knowingly false, defamatory, or misleading statements about Leva Medical PC, its doctors, or staff. Legitimate concerns should be directed to Levamedical@gmail.com for prompt resolution.

Nothing in this section restricts your right to leave honest reviews based on your actual experience, communicate with any government agency, or exercise any rights protected under the Consumer Review Fairness Act (15 U.S.C. § 45b) or any other applicable law.

10. No Returns, Exchanges, or Refunds

All sales are final. There are no returns, exchanges, refunds, store credits, or chargebacks of any kind for any Products, Services, Procedures, memberships, or subscriptions. This includes but is not limited to skincare products, nutraceuticals, garments, medical devices, and any other tangible goods purchased from Leva Medical, whether opened or unopened.

By completing your purchase, you acknowledge that you have reviewed your order, understand the nature of the Products or Services selected, and waive any right to a return, exchange, credit, refund, chargeback, or reversal of any kind. Shipping fees are non-refundable.

If you receive a damaged or defective product, contact Levamedical@gmail.com or (718) 261-1154 within 48 hours of delivery with photographic evidence. Leva Medical will evaluate the claim at its sole discretion and may, but is not obligated to, offer a replacement of the same item.

11. Chargebacks & Disputes

Before initiating any chargeback, ACH reversal, or stop-payment, you must first contact Leva Medical at Levamedical@gmail.com or (718) 261-1154 and allow 15 business days to resolve the issue in good faith. Initiating a chargeback without this good-faith resolution attempt is a material breach of these Terms. You are liable for all chargeback fees, collection costs, and reasonable attorneys' fees.

By agreeing to these Terms, you authorize Leva Medical P.C. to disclose the minimum necessary information to your card issuer or payment processor to resolve any payment dispute, including: (a) your name and date of service, (b) a description of the service category purchased, (c) your signed financial responsibility agreement, and (d) records of related communications. This disclosure is limited to payment operations as permitted under HIPAA (45 CFR § 164.506).

12. No Transfers

Payments, credits, discounts, and unused Products/Services may not be assigned, gifted, or transferred.

13. Shipping

We ship via USPS flat-rate ($5.99, U.S. only). Estimated delivery: 5-8 business days. Shipping delays or damage in transit are the carrier's responsibility and do not entitle you to a refund.

14. Medical Consent & No Guarantee

Website and marketing materials are informational only and do not replace an in-person evaluation. Outcomes vary; no specific result is guaranteed and prior results do not predict future performance.

Service Confirmation: By attending your scheduled appointment, you confirm receipt of the service. If you have concerns about the quality or outcome of any service, you must notify Leva Medical in writing at Levamedical@gmail.com within 14 days of the appointment. Failure to notify within this period constitutes acceptance of the service as rendered.

15. Assumption of Risk

You acknowledge that every medical or cosmetic Procedure carries inherent risks, which will be explained to you during your pre-procedure consultation and informed consent process. By proceeding after receiving and signing your informed consent form, you voluntarily assume the risks disclosed therein.

This section does not waive any rights you may have under New York law regarding medical malpractice, gross negligence, or willful misconduct. Nothing in these Terms limits Leva Medical's liability for conduct that cannot be limited by law.

16. Patient Satisfaction Support

Questions or concerns? Email Levamedical@gmail.com or text/call (718) 261-1154 within 30 days of purchase. We will guide product usage and, where applicable, arrange an exchange under § 10.

17. Photograph / Marketing Release

Unless you opt out in writing before treatment, you grant Leva Medical a royalty-free license to photograph and/or record your likeness (de-identified, with no personally identifiable information visible) for documentation, education, and marketing purposes.

You may revoke this consent at any time by submitting a written request to Levamedical@gmail.com. Upon receipt, Leva Medical will cease future use of your images within 30 days and remove them from digital platforms under our control. Revocation does not apply to images already published in permanent media (print publications, medical journals) or materials distributed before the revocation date.

18. Privacy & HIPAA

We protect your Protected Health Information ("PHI") per HIPAA and our Notice of Privacy Practices. Contact Levamedical@gmail.com or (718) 261-1154 with privacy questions.

Transaction Data: When you make a payment through our website or payment links, we collect device identifiers, IP address, and browser information associated with your transaction. This data is retained to verify transaction authenticity and may be shared with payment processors to resolve disputes, as permitted by applicable law.

19. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising under these Terms is limited to the amount you paid for the specific Product or Service giving rise to the claim. Indirect, consequential, incidental, special, punitive, or exemplary damages are disclaimed to the extent permitted by applicable law.

This limitation does not apply to claims arising from gross negligence, willful misconduct, fraud, or any liability that cannot be limited under New York law.

20. Indemnification

You agree to defend, indemnify, and hold harmless Leva Medical PC, its owners, employees, contractors, and affiliates from any claim, damage, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of Products, or negligent/wrongful acts.

21. Governing Law & Arbitration; Class-Action Waiver

These Terms are governed by New York law. Any dispute shall be resolved by binding individual arbitration in Queens County, NY under the AAA Commercial Rules. Class, consolidated, or representative actions and jury trials are expressly waived.

22. Attorneys' Fees

The prevailing party in any arbitration or action to enforce these Terms is entitled to recover reasonable attorneys' fees and costs.

23. Intellectual Property

All Leva Medical names, logos, trademarks, service marks, graphics, and content are protected. No license is granted without our prior written consent.

24. Age Requirement

You must be 18 years or older (or have verified guardian consent) to purchase.

25. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, pandemics, supply disruptions, or governmental actions.

26. Severability

If any provision is deemed unenforceable, the remaining provisions remain in effect.

27. Updates

We may revise these Terms at any time. For material changes affecting pricing, cancellation rights, or your payment obligations, we will provide at least 30 days' advance notice via email or text to the contact information on file. For non-material changes, posting the updated Terms on our website constitutes notice. Continued use of our Services after the effective date of any change signifies your acceptance of the updated Terms. If you do not agree with a material change, you may cancel your membership per Section 07.

29. AI-Assisted Communication & Services

Leva Medical uses artificial intelligence ("AI") tools to enhance patient communication and administrative operations, including but not limited to:

  • SMS and text messaging: Automated and AI-assisted text messages for appointment reminders, follow-ups, scheduling, and general inquiries.
  • Response generation: AI-powered draft responses reviewed and guided by Leva Medical's clinical protocols and knowledge base.
  • Administrative tasks: AI-assisted scheduling, patient intake coordination, and information delivery.

AI communications are not a substitute for medical advice, diagnosis, or treatment. All clinical decisions are made by licensed Leva Medical providers. AI-generated messages are guided by practice-approved protocols, but if you have a medical emergency, call 911.

By engaging with Leva Medical via text, phone, or online channels, you consent to receiving AI-assisted communications. You may request to communicate exclusively with a human team member at any time by replying "HUMAN" to any text message or contacting us at Levamedical@gmail.com or (718) 261-1154.

Leva Medical does not use AI to make treatment decisions, prescribe medications, or provide diagnoses. AI tools are used solely for communication, scheduling, and administrative support.
