Terms and Conditions

Every payment—whether for products, procedures, deposits, subscriptions, shipping, or fees—is irrevocable and non-refundable under any circumstance. By purchasing, you waive the right to credit-card chargebacks, check disputes, or other refund mechanisms except as expressly required by law.

 “Practice,” “we,” “us,” and “our” refer to Leva Medical PC. “Patient,” “you,” and “your” refer to the individual (or legal guardian) entering this Agreement. 

Products, services, and procedures are provided only to established Patients. New clients must call or text 718-699-9737 to complete an intake visit before purchasing.

You must (a) maintain a valid payment method on file and (b) pay each invoice on or before its due date. Late or missed payments:

• automatically cancel all appointments, services, and surgeries;
• forfeit all prior payments, credits, discounts, and deposits;
• accrue a 1.5 % monthly late fee plus any collection, chargeback, or attorney costs we incur.

 If you are denied third-party financing, we may, at our sole discretion, offer an internal plan: installments are due every 30 days; two missed installments close the account, forfeit all amounts paid, and make the outstanding balance immediately due. 

By selecting “Subscription” you:

• Commit to a 12-month initial term starting with the first successful charge (“Initial Term”).
• Authorize recurring automatic charges at the frequency shown at checkout.
• May cancel only by written notice ≥ 30 days before the next billing cycle; earlier cancellation triggers an Early Termination Fee equal to the lesser of (i) 50 % of the remaining payments or (ii) the entire remaining balance.
• After the Initial Term, the subscription converts to month-to-month and may be canceled with ≥ 30 days’ written notice.
• Understand that skipping a shipment/treatment does not pause or extend your commitment.
• Accept that pricing may be adjusted after the Initial Term with ≥ 30 days’ advance notice.
• Acknowledge that subscription benefits are non-transferable and non-refundable.

• Deposit. A non-refundable $1,000 deposit reserves your surgery date; the remaining balance is due 14 days pre-op.
• Reschedule. One complimentary date change with ≥ 14 days’ notice; later or additional changes incur a $500 fee.
• No-Show / Same-Day Cancel. The full surgical fee is forfeited.

Filing a credit-card dispute or check stop-payment without first providing us a reasonable written opportunity to resolve the issue is a material breach. You are liable for all chargeback fees, collection costs, and reasonable attorneys’ fees we incur.

 Within 30 days of purchase you may request an exchange for the same item (unopened, in saleable condition). Shipping costs are non-refundable and return postage is your responsibility. No store credit, cash refund, or credit-card refund is available. 

Payments, credits, discounts, and unused products or services may not be assigned, gifted, or transferred to any other person. 

 We ship via USPS flat-rate ($5.99 within the continental U.S.). Estimated delivery: 5-8 business days. We will notify you of back-orders or delays; such delays do not entitle you to a refund. 

Marketing and website content are educational only and do not replace an in-person evaluation. Individual results vary; no specific outcome is guaranteed and prior results do not predict future performance.

Leva Medical is dedicated to bringing you the best in medical grade skin care products. If you are not completely satisfied with a product for any reason, please contact your skin care provider at our office within 30 days of the purchase date. We’re happy to go over your concerns and chat about the best way to get the most out of your purchase.

Unless you opt out in writing before treatment, you grant the Practice an irrevocable, royalty-free right to photograph, record, and use your likeness (with identifying features removed) for medical documentation, education, and marketing.

We safeguard your Protected Health Information per HIPAA and our Notice of Privacy Practices, disclosing it only as allowed by law or with your written authorization.

 To the fullest extent permitted by New York law, our total liability is limited to the actual amount you paid for the product or service in dispute. Indirect, incidental, consequential, special, punitive, or exemplary damages are excluded. 

 You will defend, indemnify, and hold harmless Leva Medical PC, its owners, employees, contractors, and affiliates against any claim, damage, or expense (including attorneys’ fees) arising from your breach of these Terms, misuse of products, or negligent or wrongful acts. 

These Terms are governed exclusively by New York law. All disputes shall be resolved by binding arbitration in Queens County, NY under the American Arbitration Association’s rules. You knowingly waive any right to class-action litigation or a jury trial.

In any action to enforce these Terms (including arbitration), the prevailing party is entitled to recover its reasonable attorneys’ fees and costs.

All Leva Medical names, logos, trademarks, service marks, graphics, and content are protected intellectual property. No license is granted without our prior written consent.

You must be 18 years or older (or possess parental/legal guardian consent where permitted) to purchase.

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, pandemics, supplier strikes, governmental actions).

If any provision is held unenforceable, the remaining provisions remain in effect.

We may revise these Terms at any time. Continued purchases, subscriptions, or website use after posting constitute acceptance of the updated Terms.
